The Platform is intended for Athletes, coaches, and parents/guardians (where applicable).

Minors: If you are under 18, you may use the Platform only if a parent/guardian provides consent as required by the Platform’s consent workflow.

4. Accounts and registration

You agree to:

• provide accurate and complete information,
• keep your login credentials confidential,
• promptly notify us of any suspected unauthorized access.

We may suspend or restrict access if:

• required parental/guardian consent is not provided for a minor,
• the account information is materially inaccurate, or
• these Terms are violated.

5. Platform purpose and important disclaimer

The Platform provides mental performance training tools and content (e.g., role clarity, pressure routines, reflection prompts, trackers, and performance planning).

Not medical care / not therapy: The Platform is not a medical device, psychotherapy service, or clinical treatment. It does not diagnose mental health conditions. If you require medical or psychological support, please contact a qualified professional.

6. Team use and visibility (coaches, teams)

If you join through a team (e.g., “HCVW Academy” or other team), certain outputs may be shared with team staff depending on team settings.

Unless explicitly configured otherwise:

• coaches may view role outputs, completion/engagement status, and team-level insights; and
• coaches may not view private free-text inputs if such visibility is not enabled.

7. Acceptable use

You agree not to:

• use the Platform unlawfully or for harmful conduct,
• upload or transmit malware or malicious code,
• harass, threaten, or abuse others,
• attempt to access data of other users without authorization,
• reverse engineer, disrupt, or misuse the Platform.

8. User content

You may input content such as responses, notes, and logs (“User Content”). You retain ownership of your User Content.

You grant the Operator a limited, non-exclusive license to process User Content solely to:

• provide Platform features (including saving artifacts and generating outputs),
• maintain security and reliability,
• improve Platform functionality and safety.

9. AI-assisted features

The Platform may include AI-assisted functions that generate summaries, suggestions, or training plans based on user inputs.

• AI outputs are guidance tools and may contain errors.
• You are responsible for deciding whether and how to apply recommendations.
• AI features do not replace professional coaching, medical, or therapeutic advice.

10. Intellectual property

Except for User Content, all Platform software, designs, text, graphics, trademarks, and other content are owned by or licensed to the Operator. You may not copy, distribute, modify, or create derivative works except as permitted by law or expressly authorized.

11. Fees and subscriptions (if applicable)

If the Platform offers paid plans:

• applicable pricing, billing frequency, and inclusions will be displayed before purchase,
• payments are due as stated at checkout,
• refunds (if any) are governed by the applicable plan terms shown at purchase.

12. Availability and changes

We may modify, suspend, or discontinue parts of the Platform, and update these Terms from time to time. Updated Terms will be posted on the Platform with an updated “Last updated” date.

13. Disclaimer of warranties

To the extent permitted by Swiss law, the Platform is provided “as is” and “as available.” We do not guarantee uninterrupted availability, error-free operation, or specific athletic outcomes.

14. Limitation of liability

To the extent permitted by Swiss law, the Operator is not liable for indirect or consequential damages (e.g., loss of data, lost opportunities, or lost profits). Nothing in these Terms limits liability for intent or gross negligence where such limitation is not permitted.

15. Termination

You may stop using the Platform at any time. We may suspend or terminate access if you breach these Terms, if consent is missing for minors, or where continued provision is not feasible for security or legal reasons.

16. Governing law and jurisdiction

These Terms are governed by Swiss law. Jurisdiction lies with the competent courts at the Operator’s domicile in Switzerland, subject to mandatory legal provisions.
